Because she is a U.S. citizen, he learned that he could obtain permanent residence but met with Alex to better understand the process. Alex explained that A.J. did not have to depart the United States to obtain permanent residence—a departure which would trigger adverse immigration consequences—but, rather, could pursue adjustment of status under section 245(a) of the Immigration and Nationality Act (hereinafter referred to as “the Act”) despite his having overstayed the time period set out on his Form I-94 and having worked without authorization.
Alex helped A.J. file his adjustment application, including all the necessary supporting documentation to establish the bona fides of his marriage and to overcome all the prospective grounds of inadmissibility. Come the time of the interview, Alex ensured A.J. and his spouse were well-prepared to address all potential lines of questioning. Three home visits later, the agency could conclude nothing other than the fact that A.J.’s marriage was indeed bona fide. Accordingly, it granted A.J.’s adjustment application, and A.J. is now a lawful permanent resident of the United States.
